Your Use of DEK Drain® for as Long as You Own Your Home
DEK Drain® is a water
diverting system designed to collect and channel rain water to a
desired location in residential and light commercial applications.
DEK Drain® has proven to be effective under normal
weather conditions. Under extreme weather conditions,
especially in high wind situations, some degree of rainfall or
runoff can be expected to escape the system. Steps should be
taken to protect from moisture damage items and material stored
under DEK Drain® which are secure under normal
conditions.
When used in conjunction with
standard code approved residential or light commercial
construction, your use of DEK Drain® is warranted against defects
in DEK Drain® materials or workmanship and DEK Drain® will provide
replacement material within the scope of this warranty.
Oil, petroleum-based products and
grease (all sources) must be prevented from contacting the DEK
Drain® rubber substrate. Damage may result. Such damage is excluded
under this warranty. Promptly remove any grease from the DEK
Drain® system using a grease-dissolving cleaner such as Dawn, Joy
or store brand dish detergent.
The remedy stated herein is the
SOLE AND EXCLUSIVE REMEDY for defects in DEK Drain®
materials or workmanship. DEK Drain® shall not be liable for any
installation or reinstallation costs.
DEK Drain® shall under
no circumstances be liable for incidental or consequential damages
including but not limited to damages to buildings, structures or
contents within or under same.
There are no express warranties
except as stated herein, and there are no implied warranties of
any kind, including implied warranties of merchantability and
fitness for particular purpose. No representative has authority to
make any representations other than those stated herein.
This warranty is from the date of
purchase fro as long as you own the property on which DEK Drain®
is installed. This warranty is not transferable. Claims by
original purchaser only may be submitted to DEK Drain®, 6470
Freetown Road, Suite 20019, Columbia, Maryland, 21044 and must
include proof of purchase supported by original purchase invoice
showing date of purchase and sufficient quantity of material
purchase to support the claim.
This warranty shall not be
applicable to damage or fire loss in whole or part by natural
disasters, including but not limited to hurricanes or similar
natural disasters, vandalism, acts of war, or alteration of the
installation, structures, fixtures or utilities. Regular
maintenance is require of Owner to remove leaves, debris, animal
hair or other substances for the DEK Drain® system which my impede
the unrestricted discharge of captured runoff by gravity flow.
